1. Namirasoft Account Terms of Service

Namirasoft ERP operates in conjunction with Namirasoft Account and adheres to the terms set forth in the Namirasoft Account Terms of Service. By using the Service, you agree to comply with the Namirasoft Account Terms of Service, which cover authentication, security, and data handling. Please review the Namirasoft Account Terms of Service to understand your rights and obligations.

2. Account Registration

You must be registered in Namirasoft Account to access and use Namirasoft ERP. You can create or log into your account through Namirasoft Account, which is used to manage your Namirasoft products and services. By registering, you agree to comply with the Namirasoft Account Terms of Service and its Privacy Policy.

3. Use of Service

Purpose: Namirasoft ERP is a system for managing accounting and operational records. It enables you to maintain companies, branches, and fiscal years, a chart of accounts, journal entries, parties, currencies and exchange rates, and operational records such as vehicles, odometer readings, services, and maintenance plans, and to generate reports, such as the general ledger and the balance sheet, from the records you enter.

Restrictions: Misuse of the Service, including recording information you have no right to record, using the Service for unlawful purposes, interfering with system integrity, circumventing security, or disrupting the Service, is strictly prohibited.

Your Records: You are solely responsible for creating, reviewing, maintaining, and removing the records in your account, including finalizing journal entries and applying period locks.

4. Age Restrictions

The Service is not available to individuals under 18 years of age. By using the Service, you represent that you are at least 18. If we become aware that a user under 18 is using the Service, we will terminate the account and delete associated information as required. If you believe we may have information from or about a person under 18, please contact Support.

5. Data Integrity

The Service stores and processes records strictly according to the entries you make. Reports generated by the Service, including the general ledger and the balance sheet, are calculated entirely from your records and reflect the data they are based on. Namirasoft cannot be held liable for inaccuracies, imbalances, or unintended outcomes caused by the records you enter or the configurations you apply.

6. No Professional Advice

The Service is a record keeping and reporting tool. It does not provide accounting, bookkeeping, tax, audit, or legal advice, and its reports do not constitute financial statements certified by any professional. You are responsible for ensuring that your bookkeeping, reporting, and record retention meet the professional and legal standards applicable to your business, and you should consult qualified professionals where appropriate.

7. Your Responsibilities

You are solely responsible for the records you create in the Service, including their accuracy, completeness, and lawfulness. Where your records contain information about individuals other than you, such as parties who are individuals or vehicle license plates and identification numbers, you are responsible for ensuring that you have the right to record that information and that your use complies with applicable laws and Namirasoft policies.

8. Account Security

You are responsible for safeguarding your Namirasoft Account credentials and for controlling access to the records you maintain in the Service. Namirasoft cannot be held responsible for unauthorized actions resulting from your failure to secure your account.

9. Intellectual Property

All content, infrastructure, and related materials of Namirasoft ERP are the intellectual property of Namirasoft. You may not reproduce, distribute, or modify any part of the Service without Namirasoft prior written permission. Namirasoft does not claim ownership of the records you enter into the Service.

10. Disclaimer

Namirasoft ERP is provided as is and as available, without warranties of any kind, express or implied, except as required under applicable consumer protection laws. To the maximum extent permitted by law, Namirasoft is not liable for any direct, indirect, incidental, consequential, or special damages, including those arising from the records you enter, reports generated from those records, or decisions made in reliance on them.

Nothing in this Disclaimer limits your rights under applicable consumer protection laws.

11. Termination

We may suspend or terminate your access to Namirasoft ERP if you violate these Terms or misuse the Service. Upon termination, the records associated with your account may be removed. You should retain your own copies of records you are required to keep under applicable accounting and tax laws.

12. Indemnification

You agree to indemnify and hold harmless Namirasoft and its affiliates from any claims, liabilities, damages, or expenses resulting from your use of the Service, the records you create, your breach of these Terms, or your violation of any third party rights.

13. Limitation of Liability

To the fullest extent permitted by law, Namirasoft shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind arising out of or relating to the Service. No monetary or equitable remedies shall be available against Namirasoft in connection with the Service.

14. Changes to Terms and Service Availability

Namirasoft may update these Terms or modify the Service to enhance functionality, strengthen security, or comply with applicable laws.

If changes occur, users will be notified through email or announcements on the website. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the updated Terms. If you do not agree with the updates, you should discontinue use of the Service.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.
