PLEASE NOTE: YOUR USE OF AND ACCESS TO NAMIRASOFT SMS SENDER (“SERVICES”) ARE SUBJECT TO THE FOLLOWING TERMS. IF YOU DO NOT AGREE TO ALL OF THE TERMS BELOW, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY WAY.

 

Welcome to Namirasoft SMS Sender. Please read these Terms carefully as they govern your access to and use of our website(s), products, services, and applications (collectively, the “Services”). If you have any questions or concerns regarding these Terms, please contact Support.

 

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Namira Software Corporation (“Namirasoft,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms. These Terms remain in effect for as long as you use the Services and incorporate the Namirasoft SMS Sender Privacy Policy and other service specific terms by reference.

1. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes to the Services, legal requirements, or operational practices. When changes occur, we will notify you through email or by other reasonable means. Your continued use of the Services after updated Terms are published constitutes acceptance of those changes.

2. Eligibility & Account Registration

Age Requirement: You must be at least 18 years old and legally capable of entering binding contracts.

 

Account Registration: You must register and log in using your Namirasoft Account.
Registration, authentication, and related data are governed by the Namirasoft Account Privacy Policy.

 

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

3. Sending Messages via SMS

Namirasoft SMS Sender allows you to send SMS messages to phone numbers by connecting an SMS provider configured in the console. Currently, SMS delivery is supported through AWS-based SMS services.

 

You are responsible for:

 

  • Providing accurate provider configuration details, including AWS Access Keys and region

 

  • Ensuring phone numbers are valid and authorized

 

  • Completing phone number verification before sending messages

 

Namirasoft does not originate SMS traffic independently and does not act as a telecommunications carrier. All message delivery is executed through third party providers configured by you.

4. Permitted Use & Restrictions

You may use Namirasoft SMS Sender to deliver automated or manual messages to phone numbers you control or are permitted to contact.

You must not:

 

  • Use the Services to send spam, unsolicited messages, or unlawful communications

 

  • Send messages that violate applicable laws or regulations, including SMS compliance requirements

 

  • Interfere with or disrupt the operation of the Services or third party providers

 

  • Attempt to reverse engineer, copy, or misuse the platform

 

  • Share account credentials or provider secrets with unauthorized parties

 

Namirasoft reserves the right to suspend or terminate access for violations of these Terms.

5. Integration with Other Namirasoft Services

Namirasoft SMS Sender supports both automated and manual delivery of messages. It can receive automated messages from Namirasoft Notification Sender or be used directly by the user through the Namirasoft SMS Sender Console.

 

When integrated with Namirasoft Notification Sender, messages are triggered based on conditions defined in that system. All routing logic, triggers, and delivery rules are managed by Namirasoft Notification Sender and follow Namirasoft Notification Sender Terms of Service.

6. Third Party Providers and AWS Responsibility

Namirasoft SMS Sender relies on third party infrastructure, including AWS SMS services, to deliver messages.

 

Namirasoft does not operate, control, or guarantee the performance of AWS or other external providers. Any outages, delays, delivery failures, rate limits, regional restrictions, or policy changes imposed by AWS or telecommunications networks are outside Namirasoft’s control and responsibility.

 

You are solely responsible for maintaining valid AWS credentials, ensuring sufficient service limits, and complying with AWS terms and policies.

7. Reliability and availability

While Namirasoft designs its systems for reliable operation, SMS delivery depends on factors outside our control, including third party provider availability, carrier networks, regional restrictions, and network conditions.

8. Termination

By You: You may cancel your subscription or delete your account at any time through the Namirasoft Account.

 

By Us: We may suspend or terminate your access to the Service for violations of these Terms or for legal/regulatory compliance.

 

Upon termination, your access will be revoked and data will be managed in accordance with Namirasoft Account Privacy Policy.

9. Intellectual Property

All rights, title, and interest in Namirasoft SMS Sender, including software, content, branding, and documentation, are owned by Namirasoft or its licensors.

 

You are granted a limited, non exclusive, non transferable license to use the Services solely in accordance with these Terms. No ownership rights are transferred.

10. Disclaimers

Namirasoft SMS Sender and all features are provided “as is” and “as available.” To the fullest extent permitted by law, Namirasoft disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

 

Users are responsible for how they configure and use the service. Nothing in this section affects your rights under applicable consumer protection laws.

11. Limitation of Liability

To the maximum extent permitted by law, Namirasoft shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the service.

 

If you are using the service free of charge, Namirasoft’s total liability is limited to the extent permitted under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Namirasoft, its affiliates, and its personnel from any claims, liabilities, losses, or expenses arising from your use of the Service, your violation of these Terms, or any infringement by you of third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and applicable Canadian law. Any disputes arising from your use of the Service shall be resolved in the courts located in British Columbia.

14. General Terms

  • Assignment: You may not assign these Terms without our written consent.

 

  • Severability: If any provision is found invalid, the rest remain enforceable.

 

  • Entire Agreement: These Terms, along with our Privacy Policy and other referenced agreements, constitute the entire agreement between you and Namirasoft regarding SMS Sender.
