Terms of Service

Namirasoft Email Sender (“the Service”) is owned and operated by Namira Software Corporation (“Namirasoft,” “we,” “us,” or “our”).

 

These Terms of Service (“Terms”) govern your access to and use of Namirasoft Email Sender, including all related features, consoles, and integrations. By using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

 

Please read these Terms carefully. If you do not agree with any part, you must not use Namirasoft Email Sender.

1. Account Registration and Access

To use Namirasoft Email Sender, you must have an active Namirasoft Account, which provides secure access to Namirasoft products and services. All account registration, authentication, and identity management are handled under the Namirasoft Account Terms of Service and Privacy Policy.

 

You agree to:

 

  • Provide accurate and current information when registering.

 

  • Keep your credentials secure and confidential.

 

  • Accept full responsibility for any activity performed under your account.

 

Namirasoft reserves the right to suspend or terminate access if we detect misuse, false information, or violations of these Terms.

2. Purpose and Scope of the Service

Namirasoft Email Sender allows users to send messages via email using their verified providers or receive automated system notifications and alerts generated by other Namirasoft applications.

 

The Service offers two primary functions:

 

  • Provider Management: Create and manage email providers (Namirasoft, Gmail, AWS, SMTP).

 

  • Send Console: Send manual email messages using configured and verified providers.

 

Note: The Namirasoft Provider type is pre-verified and reserved exclusively for system-generated alerts and notifications. It cannot be used to send manual messages.

3. Acceptable Use and User Conduct

Users must use the Service responsibly and in compliance with applicable laws. You agree not to:

 

  • Send spam, unsolicited bulk messages, or unauthorized commercial content.

 

  • Use unverified or unauthorized providers.

 

  • Impersonate other individuals or organizations.

 

  • Interfere with the operation or security of the Service.

 

  • Reverse-engineer, copy, or extract the system source code.

 

Namirasoft may suspend or terminate access if such violations occur. We may also investigate activities suspected to be fraudulent or unlawful and cooperate with authorities where required.

4. Integration with Other Namirasoft Services

Namirasoft Email Sender may integrate with other Namirasoft products, especially Namirasoft Notification Sender. When integrated, these systems communicate through secure APIs and internal authorization channels. In this case, the use of such integrations is governed by the Terms and Policies of that service.

5. Use of Third-Party Providers

The Service supports integration with third-party email services, including Gmail, Amazon Web Services (AWS), and SMTP-based systems.

 

When you choose a third-party provider, your use of that service is governed by its own terms and policies:

 

 

 

  • SMTP Providers: Subject to each provider’s applicable terms.

 

Namirasoft is not responsible for the content, reliability, or availability of these external services. You are solely responsible for managing your credentials and compliance with their terms.

6. Service Reliability and Delivery

Namirasoft Email Sender is developed to provide dependable and secure message delivery across supported email providers. However, message transmission may be influenced by external conditions beyond Namirasoft’s control.

 

Such factors include, but are not limited to:

 

  • The performance, uptime, or service behavior of third-party APIs (including Gmail, AWS, or SMTP providers).

 

  • User-side configuration errors, including incorrect credentials, misconfigured providers, or invalid recipient addresses.

 

  • Network or internet connectivity issues affecting message dispatch or receipt.

 

  • Any restrictions or failures arising from third-party email systems or service providers.

 

Namirasoft is not responsible for any interruption, delay, or failure in message delivery caused by misconfiguration, connectivity problems, or external dependencies. Users are solely responsible for ensuring correct configuration and are encouraged to review the Reports section in the Namirasoft Email Sender console to verify message delivery status and identify potential issues.

7. Suspension, Termination, and Data Deletion

Namirasoft reserves the right to suspend or terminate your access to Namirasoft Email Sender at its sole discretion if you violate these Terms, misuse the Service, or engage in any activity that may compromise the security, stability, or lawful operation of the platform.

 

Users may stop using the Service at any time. To permanently remove all associated data, users must submit an account deletion request through their Namirasoft Account console. Once the request is verified and approved, Namirasoft will  delete user-related data in accordance with both the Namirasoft Account Privacy Policy and the Namirasoft Email Sender Privacy Policy, as well as any applicable legal and operational requirements.

 

Data retention, handling, and deletion timelines are managed based on these policies to ensure compliance with privacy laws and to maintain the integrity of system operations.

8. Intellectual Property Rights

Namirasoft Email Sender, including all software, systems, and interfaces, remains the exclusive property of Namirasoft. You are granted a limited, non-exclusive, and non-transferable license to use the Service for its intended purpose.

 

No intellectual property rights are transferred or assigned through the use of this Service.

9. Limitation of Liability

To the fullest extent permitted by law, Namirasoft shall not be liable for:

 

  • Any indirect, incidental, special, or consequential damages;

 

  • Loss of data, profits, or business opportunities;

 

  • Any failures or delays caused by third-party services.

 

If you are using the Service free of charge, Namirasoft’s liability is limited to the minimum extent permitted by applicable law.

10. Indemnification

You agree to indemnify and hold harmless Namirasoft, its affiliates, and personnel from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Modifications to the Terms

Namirasoft may update these Terms to reflect changes in law, features, or operational conditions.
We will notify users through email or in-app notices prior to the effective date. Continued use of the Service constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia, Canada, and applicable Canadian law.

 

Any dispute arising from these Terms shall be submitted to the courts located in Vancouver, British Columbia.
