Terms of Service

Namirasoft Container Registry (the Service) is owned and provided by Namira Software Corporation (Namirasoft, we, us, or our). These Terms of Service (the Terms) govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

Namirasoft Container Registry is part of the broader Namirasoft ecosystem and operates together with your Namirasoft Account. Use of the Service is also subject to the Namirasoft Account Terms of Service. These Terms apply specifically to Namirasoft Container Registry and do not replace the Namirasoft Account Terms of Service. If there is any conflict between the two for your use of this Service, these Terms control for the Service. We may update these Terms over time; see Changes to These Terms.

1. Definitions

  • Namirasoft: Namira Software Corporation.
  • Service: Namirasoft Container Registry.
  • Namirasoft Services (the ecosystem): the broader family of Namirasoft products that operate with your Namirasoft Account.
  • Account: your Namirasoft Account, which authenticates you across Namirasoft Services.
  • Registry connection: a record you create that links to one of your existing container registries so you can manage it in the Service.
  • Credential: the sign-in for a registry, which you create and store in Namirasoft Credential and reference from a connection.
  • Workspace: the Namirasoft Workspace a connection belongs to.

2. Account Registration

To use Namirasoft Container Registry you must have an active Namirasoft Account. Your Namirasoft Account authenticates you and associates your connections with your account. Registration and identity are governed by the Namirasoft Account Terms of Service and the Namirasoft Account Privacy Policy.

3. Age Requirement

The Service is not intended for individuals under 18 years of age. By using the Service, you represent that you are at least 18 years old. Eligibility and accounts are managed by Namirasoft Account; if Namirasoft Account determines that an account belongs to a person under 18, the account and its information are handled under the Namirasoft Account Terms of Service.

4. Account Security

You are responsible for keeping your Namirasoft Account credentials and tokens confidential and for all activity that occurs under your account, including the connections you create. Any use of the Service through your account is considered authorized by you. Report any unauthorized access or suspected misuse promptly through support.namirasoft.com.

5. Description of the Service

  • Connect your registries: Namirasoft Container Registry lets you create connections to your existing container registries, such as Amazon ECR, Azure ACR, Google, GitHub, GitLab, Harbor, JFrog Artifactory, Sonatype Nexus, a private registry, or a public repository, each referencing a credential you store in Namirasoft Credential.
  • Manage them in one place: you can organize your connections by Workspace, category, tag, and field, and manage them together.
  • Connection records only: the Service manages the connection records; it does not store or move the images in your registries, which stay with your registry providers.

Namirasoft may provide the Service on its own or as part of your Namirasoft Services. Where any fees apply, they are handled by Namirasoft Payment under its own terms, and you continue to pay your registry providers directly under your own agreements with them.

6. Using the Service and Acceptable Use

You are responsible for the connections you create, the credentials you reference, and the registries you connect. You agree to use the Service only for lawful purposes, to connect only registries and credentials you are authorized to use, and not to use the Service in support of unlawful, infringing, or malicious activity. You agree not to overload, disrupt, or attempt to abuse the Service or its infrastructure, and not to configure connections in a way designed to evade limits or controls. Because the Service manages connection records and does not move or store your images, you remain responsible for the images in your registries and for your use of your registries and credentials under their own terms.

7. Your Connections and Content

You are responsible for the connections you create and for being authorized to use the credentials and registries you reference. You retain your rights in your content, and you grant Namirasoft the right to store your connection records and to associate them with the credential you selected in Namirasoft Credential, as needed to provide the Service. The images and other contents of your registries are not handled by the Service and remain with your registry providers under their own terms. The collection, use, storage, retention, and protection of the information handled by this Service are governed by the Namirasoft Container Registry Privacy Policy and, for identity and authentication, the Namirasoft Account Privacy Policy.

8. General Acceptable Use

When using the Service, you also agree to: use it only for its intended purpose and in compliance with applicable laws; not attempt to access connections or accounts that are not yours; not interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure; not reverse engineer, decompile, scrape, or use automated means to extract data from the Service, or attempt to discover its source code or underlying structure, except to the extent this restriction is prohibited by law; not conduct security testing without our prior written permission; and report unauthorized access or suspicious activity promptly.

9. Your Registries and Third-Party Services

The container registries you connect are provided by third parties, or run by you, under their own terms and policies, and you are responsible for complying with them and for the credentials you use to connect. Namirasoft is not responsible for the independent practices, availability, or actions of your registry providers, and the images in your registries are handled by them, not by the Service. Namirasoft Container Registry otherwise operates within the Namirasoft ecosystem and interoperates with other Namirasoft products, such as Namirasoft Credential, each governed by its own terms. If you separately access a service outside the Namirasoft ecosystem, that service is governed by its own terms.

10. Intellectual Property

The Service, including its software, design, text, and trademarks, is owned by Namirasoft and protected by applicable laws. You retain any rights you may have in the content you provide, and Namirasoft does not claim ownership of your underlying business records or data. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted. If you send us feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use them to improve our products, without obligation to you.

11. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Namirasoft works to keep the Service reliable and available, and to the extent permitted by law it is provided without a warranty that it will be uninterrupted or error free, or that your registry providers will be available or perform as expected. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of Liability

To the maximum extent permitted by law, Namirasoft and its personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising from or related to your use of or inability to use the Service, including any issue with your registries, credentials, or the images they hold, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the total amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred Canadian dollars if you paid nothing. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of these limitations may not apply to you, and in those cases our liability is limited to the smallest amount permitted by law.

13. Consumer Rights

Nothing in these Terms limits, excludes, or modifies any right or remedy you may have under applicable consumer protection law that cannot legally be limited, excluded, or modified. Where such law applies, the disclaimers and limitations above apply only to the extent permitted by that law.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Namirasoft and its personnel from any claims, damages, liabilities, and reasonable expenses arising out of your use of the Service, the connections you create and the registries and credentials you reference, your violation of these Terms or of your registry provider’s terms, or your violation of applicable law or the rights of a third party. This section does not apply to the extent a claim results from Namirasoft’s own conduct.

15. Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that risks harm to others or to the ecosystem. We may also suspend access temporarily, with or without notice, to protect the security and integrity of the Service, its users, or the ecosystem, including where your account appears compromised or shows suspicious activity. Where reasonable and lawful, we will provide notice. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.

16. Modifications to the Service

We may change, improve, or discontinue features of the Service over time, including the registry types available. Where a change materially reduces core functionality, we will make reasonable efforts to provide notice through Namirasoft Services.

17. Export and Sanctions Compliance

You represent that you are not located in, and will not use the Service from, a country or region subject to comprehensive sanctions, and that you are not a person with whom dealings are prohibited under applicable Canadian or United States trade and sanctions laws. You agree to comply with all applicable export control and sanctions laws in your use of the Service.

18. Dispute Resolution and Governing Law

Before starting any formal proceeding, you agree to first contact us at accounts@namirasoft.com and attempt in good faith to resolve the dispute informally for at least thirty days. These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict of laws principles. You and Namirasoft agree to the exclusive jurisdiction of the courts located in British Columbia, Canada, for any dispute not resolved informally. Nothing in this section prevents you from bringing a claim in a small claims court or a consumer tribunal where applicable law gives you that right.

19. Force Majeure

Namirasoft is not liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, outages, network or infrastructure failures, acts of government, labor disruptions, or the unavailability of a registry provider.

20. Assignment

You may not assign or transfer these Terms without our prior written consent. Namirasoft may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and benefit the parties and their permitted successors.

21. Entire Agreement

These Terms, together with the Namirasoft Account Terms of Service and any documents they reference, form the entire agreement between you and Namirasoft regarding the Service, and supersede any prior agreements on that subject.

22. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later.

23. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

24. Notices

We may provide notices to you through the Service, through Namirasoft Account, or by email to the address associated with your account. You may send notices to us at accounts@namirasoft.com.

25. Survival

Sections relating to acceptable use, your connections and content, intellectual property, disclaimers, limitation of liability, consumer rights, indemnification, dispute resolution, and any other provisions that by their nature should survive, will survive termination of these Terms.

26. Changes to These Terms

Namirasoft may update these Terms at any time to reflect changes in the Service, legal requirements, or security practices. When material changes occur, Namirasoft may notify users through email and/or announcements through the Service or its website, where appropriate or as required by applicable law. Your continued use of Namirasoft Container Registry after updates are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
