Namirasoft Alarm (the “Service”) is operated by Namira Software Corporation (“Namirasoft”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the Service. By using Namirasoft Alarm, you confirm that you have read, understood, and agreed to be bound by these Terms.
Your use of Namirasoft Alarm also constitutes acceptance of the Namirasoft Account Terms of Service, which apply to all Namirasoft applications and establish your general account rights and obligations.
1. Account and Access Requirements
You must hold an active Namirasoft Account to use Namirasoft Alarm. Account registration and management are handled through Namirasoft Account. By registering or continuing to use the Service, you agree to comply with all applicable account-level Terms and Policies.
Namirasoft may, at its discretion, suspend or restrict access to the Service if account integrity, security, or compliance concerns are identified.
2. Acceptable Use
The Service is intended solely for legitimate monitoring, alerting, and automation activities within the Namirasoft ecosystem. You agree not to misuse the Service or use it in any manner that could disrupt, damage, or compromise system functionality or interfere with other users.
Any attempt to create false alarms, exploit system vulnerabilities, or abuse notification channels may result in suspension or permanent termination of your access.
3. Age Restriction
Use of the Service is restricted to individuals who are at least 18 years old. By accessing or using Namirasoft Alarm, you represent and warrant that you meet this requirement.
If it is determined that a user under 18 has accessed the Service, Namirasoft may terminate the account and permanently remove all associated information.
4. Data and Notification Accuracy
Namirasoft Alarm operates based on configurations and parameters defined by the user. Notifications and alarms generated by the Service depend on your defined criteria and connected systems.
Namirasoft Alarm is responsible for generating and forwarding alarms based on the parameters, limits, and configurations defined by the user. Once an alarm is delivered to Namirasoft Notification Sender for distribution, its handling, delivery, and reliability are governed by the Terms of Service of Namirasoft Notification Sender.
5. Intellectual Property
All intellectual property rights related to Namirasoft Alarm, including software, design, documentation, and branding, are the exclusive property of Namira Software Corporation.
You may not reproduce, copy, distribute, sell, or create derivative works from any part of the Service without prior written consent from Namirasoft.
6. Limitation of Liability
To the fullest extent permitted by law, Namirasoft and its affiliates shall not be held liable for any damages, losses, or interruptions resulting from your use of Namirasoft Alarm.
You acknowledge that your use of the Service is at your own discretion and that you remain responsible for how alerts and notifications are configured and acted upon.
7. Termination
Namirasoft reserves the right to suspend or terminate access to Namirasoft Alarm, with or without prior notice, if it determines that your account or activity violates these Terms or any applicable laws.
You may stop using the Service at any time by discontinuing access or closing your Namirasoft Account.
8. Changes to Terms of Service
Namirasoft may update or modify these Terms from time to time. If changes are made, we will notify users by email and/or through in-app notifications within Namirasoft Alarm. Updates will take effect immediately upon publication unless otherwise specified.
By continuing to use the Service after changes are communicated, you agree to the revised Terms. If you do not agree with the modifications, you must stop using Namirasoft Alarm.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
Any dispute, claim, or legal proceeding arising from or related to these Terms or your use of the Service shall be exclusively resolved in the courts of British Columbia, Canada.
